Digital Millennium Copyright Act (DMCA) Policy

Lumardox respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, we will respond expeditiously to claims of copyright infringement committed using our website or platform if such claims are reported to our designated Copyright Agent.
Reporting Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please notify our Copyright Agent as specified below. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest
- A description of the copyrighted work that you claim has been infringed
- A description of where the material that you claim is infringing is located on our platform, with sufficient detail that we may find it
- Your address, telephone number, and email address
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Counter-Notification
If you believe that your content that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content, you may send a counter-notice to our Copyright Agent containing the following information:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the court in your location, or if you are outside Ukraine, for any judicial district in which Lumardox may be found
- A statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Lumardox has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to our platform and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Processing of Notices
Upon receipt of a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the content provider, member, or user that we have removed or disabled access to the material
- Provide the content provider, member, or user with a copy of the notice
- Terminate the accounts of repeat infringers in appropriate circumstances
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original claim. The original complainant will then have ten business days to notify us that they have filed legal action relating to the allegedly infringing material. If we do not receive such notification, we may restore the removed material.
False Claims
Please be aware that under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.
Modifications
Lumardox reserves the right to modify, alter, or add to this policy at any time. We will notify users of any material changes by updating the date at the top of this policy. Your continued use of our platform following the posting of changes constitutes your acceptance of such changes.
